Only in narrow circumstances — California NPs may prescribe amphetamine, a Schedule II stimulant, only if the NP has California furnishing authority, DEA registration, and the order fits either the standardized-procedure pathway or a qualifying Section 2837.103/2837.104 independent-practice pathway.134 The NP must also have required Schedule II education and stay within education, training, competence, scope, and applicable protocols or independent-practice authority.
For NPs practicing under standardized procedures, Schedule II drugs must be specified in the standardized procedure, and Schedule II or III furnishing must follow a patient-specific protocol approved by the treating or supervising physician.12 Qualifying 103/104 NPs may prescribe controlled substances without standardized procedures when that statutory pathway applies.4
Because amphetamine is Schedule II, California’s CURES review requirement applies unless an exemption applies.5 These limits mean Schedule II stimulant prescribing is not unrestricted for all California NPs.
