What are the requirements for terminating a collaborative agreement in New York?

In New York, there are no specific statutory or regulatory requirements for terminating an NP–physician collaborative agreement. New York law and regulations detail how practice agreements and protocols must be established and what they must contain, but they do not prescribe termination procedures for ending a collaboration12.

Because the rules focus on creating and maintaining agreements and protocols, ensure compliance with existing provisions during any transition. For example, practice protocols must be filed within 90 days of commencing practice and may be updated; the Department may review protocols and require revisions within 30 days if issues are identified34. Both parties must also maintain practice agreements and protocols in their practice settings and make them available to the Department upon request5.
